This is a yearly contract to auto renew at end of 12 month period.

• To assure continued protection, the contract will be automatically charged on the 1st of every month; for the monthly fee agreed to on the form.
• This contract will auto renew ;unless a written notice is given to Air Comfort Heating & Air Conditioning, Inc. 30 days prior to end date .   
• If payments are missed or late, Air Comfort Heating & Air Conditioning, Inc. may demand immediate payment
• If the the contract is cancel before the end of 12 month contract  period the amount of services, tune ups, parts, and warranty will be charged at full price plus trip charges for each visit.
• The total  amount paid to the Air Comfort Plus maintenance program that has been paid in the 12 month contract.; will be total up and the charges for services rendered in that same period, will be deducted from said total and the remaining balance will be paid in full in 30 days of cancel date.
• If a price increase is needed it will be done at the time of the auto renew.
• This maintenance plan contract applies to one single address per agreement and cover specific maintenance services.
• Equipment must meet code requirements and be in operating condition at the time program service begins. Air Comfort Heating & Air Conditioning, Inc. must have safe access to, and safe working conditions at and around the equipment.
• Air Comfort Heating & Air Conditioning, Inc. is not responsible for any form of damages, including direct, indirect, consequential, incidental punitive or other forms of damages, claims, assessments or demands, resulting from; (1) delays in providing service, (2) unavailability of parts (3) labor difficulties, strikes, etc. (4) Natural disasters or other force majeure, or (5) any other conditions beyond the control of Air Comfort Heating & Air Conditioning, Inc. Under no circumstances shall Air Comfort Heating & Air Conditioning, Inc. be liable for any attorney’s fees; cost of investigation, court costs, or other assessments incurred in any legal action brought relating to this contract. Under this contract during the term in which the claim arouse. Program service does not cover any material, parts, and labor required as result of abuse, vandalism, fire, freezing, acts of God, power or water supply outages, flooded cellars, or other abnormal conditions Air Comfort Heating & Air Conditioning, Inc. will not be required to perform program services until any asbestos hazard is eliminated and Air Comfort Heating & Air Conditioning, Inc. determines, at its discretion, that no hazard exists.
• If repairs are identified during the course of your seasonal maintenance visits, at your option you may choose to have Air Comfort Heating & Air Conditioning, Inc. complete the repairs and you will receive 15% off and a 3 year warranty on parts we install.
• We will send out text/email notice of seasonal maintenance; it is your responsibility to call office and set up an appointment.
•  Air Comfort Heating & Air Conditioning, Inc. has the right to increase prices on any agreement as necessary in operating a profitable business. Written notice will be given 30 days in advance of any price increase.
• This agreement cannot be transferred to a new address. A new agreement must be set up for the new address.

Parts & Labor Warranty (on all repairs and /or upgrades and accessories)
This warranty sets forth the entire agreement between Air Comfort Heating & Air Conditioning, Inc. and the Customer and cannot be changed without written approval from Air Comfort Heating & Air Conditioning, Inc. representations and promises made by any person not contained in this document are not part of these warranties.

• These warranties as such a lapse in payment by the customer automatically terminates said warranty coverage provided by Air Comfort Heating & Air Conditioning, Inc. From the date of lapse payment.
• Air Comfort Heating & Air Conditioning, Inc. has a 3 year warranty on parts we install while you are on the AIR COMFORT PLUS PROGRAM. All repairs will only be covered while still on the program at the time of the repair. However Air Comfort Heating & Air Conditioning, Inc. has the right to void any agreement should necessary repairs not be accepted that would prevent the system from operating properly, thus creating more service calls  due to the condition and /or relation of necessary repairs.
• These warranties are inclusive of the manufacturer’s warranty. They do not replace the manufacturer’s warranty, but provide certain additional benefits. Losses fully covered by the manufacturer’s warranty are not covered under these warranties.
• Any material and /or work covered under this warranty will be provided by Air Comfort Heating & Air Conditioning, Inc. No compensation will be provided for work completed by any other servicer. Any work performed by any other servicers will automatically terminate these warranties. Any material and/or work beyond what is covered by the terms of this Warranty will be furnished at customer’s expense.
• Obligations under these warranties are limited to the repair of failed (not functional) parts on covered systems, and Air Comfort Heating & Air Conditioning, Inc. has no liability beyond this repair. In no case is. Air Comfort Heating & Air Conditioning, Inc. liable for any special or consequential damage that may result from the failure of covered systems.
• Air Comfort Heating & Air Conditioning, Inc. shall not be liable for losses, failures, or defects that are not a result of manufacturing defects or workmanship, such as:
  1. Damage from fire, water, wind, storms, earthquake, or other Acts of God or nature, faulty power supply, theft, vandalism, misuse, or abuse, lack of maintenance, etc.
  2. Alterations to the equipment to meet changes in Federal, State, or local codes or regulations.
  3. Appearance, aesthetics, paint, and cabinet parts, knobs, and buttons including but not limited to rust or corrosion.
  4.  Normal wear and tear.

In such cases, the customer shall be charged for the repairs involved at the current price for such repairs. No such repairs shall be furnished, however, without authorization from the customer.
 
Parts & Labor Warranty (on all repairs and /or upgrades and accessories

1. Air Comfort Heating & Air Conditioning, Inc. will conditionally warranty all repairs and /or upgrades and accessories purchased from. Air Comfort Heating & Air Conditioning, Inc. for covered systems by the program member while they are continually participating in the AIR COMFORT PLUS maintenance agreement
2. Warranty is subject to availability of replacement parts. Air Comfort Heating & Air Conditioning, Inc. cannot guarantee parts which are no longer manufactured or otherwise unavailable through regular distribution channels.
3.  3. Subject to the above conditions, this warranty will remain in force for the term while the customer is residing in the home, program expires, or the date of the warranty period ends.
4. Each repair term coverage will be carried over for the coverage period when it is continuously renewed. Annual maintenance is required for repairs to be honored. Skipped or missed tune-ups on effected pieces of equipment will terminate the said repair coverage.

** 50% of your membership can be used toward installation of heating & cooling equipment. Valid  if customer is  up to date on payments and living at the same address as the original contract with Air Comfort Heating & Air Conditioning, INC. The qualifying equipment for this program is as follows; furnace, air conditioning, boiler, ductless mini split, heat pump, air exchanger, and dehumidifier.
