MAINTENANCE MEMBERSHIP TERMS & CONDITIONS
Clear terms for your Comfort Plus membership, maintenance benefits, billing, promotional offers, warranties and cancellation.
Important: The $39 Tune-Up Is A Promotional Offer, Not A Standard Comfort Plus Benefit.
Customers may join Comfort Plus through a technician, an Air Comfort representative, the website, a service visit, or another standard enrollment method without receiving the $39 promotional tune-up.
The $39 tune-up applies only when Air Comfort specifically offers the promotion and the customer qualifies for and accepts that promotion.
Membership Term & Monthly Billing
Air Comfort Plus (“Comfort Plus”) is a maintenance membership offered by Air Comfort Heating & Air Conditioning, Inc. (“Air Comfort”).
The initial Comfort Plus membership term is 12 months. Membership dues are billed monthly at the rate and coverage level selected and disclosed at enrollment.
The first monthly membership payment is due at enrollment. Subsequent monthly payments will be charged to the payment method on file according to the billing schedule established at enrollment.
Pricing may vary based on the equipment and optional coverage selected. Additional systems, filters, humidifiers, air exchangers, mini-splits, or other equipment may require additional membership charges.
Automatic Renewal
Unless canceled as provided in these Terms & Conditions, Comfort Plus may automatically renew after the initial 12-month term according to the renewal terms disclosed to the member at enrollment and in the member's enrollment confirmation.
Before enrollment, Air Comfort will disclose the applicable recurring charge, length of the initial membership obligation, renewal structure and cancellation policy.
Membership pricing may change for a future renewal term. Air Comfort will provide notice of applicable price changes as required before the new price takes effect.
Standard Enrollment vs. Promotional Enrollment
Standard Comfort Plus Enrollment
Standard enrollment includes customers who enroll through an Air Comfort technician, office representative, website, service visit or other enrollment method without accepting a specific promotional offer.
Standard members receive the Comfort Plus benefits included with the coverage selected at enrollment. A promotional price or promotional tune-up is not automatically included with standard enrollment.
Promotional Enrollment
Promotional enrollment occurs when Air Comfort specifically presents a promotional offer and the customer qualifies for and accepts that offer in connection with Comfort Plus enrollment.
Promotional benefits are not permanent standard membership benefits and apply only according to the specific terms of the promotion.
$39 New-Member Promotional Tune-Up
When specifically offered by Air Comfort, qualifying new Comfort Plus members may receive one qualifying furnace OR air-conditioning tune-up for $39.
Unless different written promotional terms are provided, the $39 promotional tune-up:
- Applies only to eligible customers who enroll through a qualifying $39 promotional offer.
- Is limited to one qualifying promotional tune-up per eligible new membership or household.
- Applies to one qualifying furnace OR one qualifying central air-conditioning system.
- Is separate from monthly Comfort Plus membership dues.
- Does not replace, reduce or satisfy monthly Comfort Plus membership payments.
- Is charged separately from the monthly membership.
- Is subject to qualifying equipment, Air Comfort's service area, safe equipment access, technician availability and applicable scheduling limitations.
Customers who join Comfort Plus during a regular service visit or through another standard enrollment method do not automatically qualify for the $39 promotional tune-up unless the promotion was specifically offered and accepted as part of that enrollment.
For customers enrolled through the qualifying $39 promotion, Air Comfort will contact the customer to arrange scheduling of the promotional tune-up.
Comfort Plus Membership Benefits
Benefits depend on the coverage selected at enrollment and may include:
- Annual qualifying maintenance on covered furnaces and air-conditioning systems.
- Reduced qualifying diagnostic fees during applicable service hours.
- Priority service benefits.
- 15% off qualifying repairs.
- Three-year warranty protection on qualifying parts installed by Air Comfort while applicable membership requirements are satisfied.
- Eligibility to apply 50% of qualifying membership dues paid toward qualifying replacement equipment purchased and installed through Air Comfort, subject to the requirements below.
Filters are not included unless the customer purchases applicable filter coverage or another written agreement specifically provides otherwise.
Seasonal Maintenance & Scheduling
Air Comfort may notify members by text, email, telephone or other communication when seasonal maintenance scheduling is available.
Except where a promotional offer specifically states that Air Comfort will contact the member to arrange the visit, the member is responsible for contacting Air Comfort to schedule regular seasonal maintenance.
All maintenance appointments are subject to technician availability, service-area requirements, safe access, qualifying equipment and seasonal demand.
Unused maintenance visits have no cash value and do not automatically convert into a refund or account credit unless Air Comfort agrees otherwise in writing.
Equipment Eligibility & Access
Each Comfort Plus membership applies to one service address and the specific equipment covered under the membership.
Covered equipment must meet applicable code requirements and must be in operating condition when program service begins unless Air Comfort agrees otherwise.
The customer must provide safe and reasonable access to covered equipment.
Air Comfort is not required to perform maintenance or repair work where unsafe conditions exist, including hazardous materials or asbestos, until Air Comfort determines that the condition has been appropriately corrected.
Membership coverage is not automatically transferable to another service address. A new or revised agreement may be required if the customer moves.
Repairs Identified During Maintenance
If Air Comfort identifies recommended repairs during maintenance, the customer may choose whether to authorize the work.
Qualifying repairs performed by Air Comfort while the membership is active may receive the applicable Comfort Plus repair discount and warranty benefits.
Repairs, replacement equipment, accessories and other work are not included in the monthly membership dues unless expressly stated as a covered membership benefit.
Cancellation During The Initial 12-Month Term
A member may provide notice that the member wishes to cancel or terminate the membership using the cancellation methods made available by Air Comfort and as required by applicable law.
If a member seeks to end the membership during the initial 12-month term after receiving membership services, discounts, promotional savings or other qualifying benefits, Air Comfort may reconcile the account.
Subject to applicable law and the specific enrollment agreement, the amount due following reconciliation will not exceed the lesser of:
The remaining unpaid membership dues for the member's initial 12-month membership term.
The regular value of qualifying membership services, discounts, promotional savings and benefits already received, minus applicable amounts already paid.
A separately paid promotional service will not be charged twice as part of this calculation.
For example, if an eligible promotional member paid $39 for a promotional tune-up, the $39 already paid would be credited when calculating the value of applicable promotional benefits received.
Air Comfort will communicate any applicable account reconciliation and amount due to the member.
Canceling Automatic Renewal
Members may provide notice that they do not wish the membership to renew by using the cancellation or termination options provided by Air Comfort.
A termination or cancellation request will take effect according to the applicable membership term and applicable law.
Cancellation of a future renewal does not eliminate amounts properly owed for the existing initial term or separately authorized services already performed.
Air Comfort will provide available cancellation methods with the member's enrollment confirmation.
Failed or Late Membership Payments
If a scheduled membership payment fails or becomes delinquent, Air Comfort may suspend applicable Comfort Plus benefits until the account is brought current.
Continued nonpayment may result in termination of membership benefits and may affect membership-related warranty coverage, subject to applicable law and the warranty provisions of these Terms & Conditions.
Parts & Repair Warranty
Qualifying repairs, upgrades and accessories purchased from and installed by Air Comfort may receive warranty benefits applicable to the customer's Comfort Plus coverage.
The current Comfort Plus program provides a three-year warranty on qualifying parts installed by Air Comfort , subject to continuous applicable membership coverage and the conditions of these Terms & Conditions.
Manufacturer warranties remain separate. Comfort Plus warranty benefits supplement and do not replace applicable manufacturer warranty coverage.
Warranty service must be performed by Air Comfort unless Air Comfort provides written authorization otherwise. Air Comfort does not reimburse unauthorized work performed by another service provider.
Warranty Exclusions
Unless otherwise required by law or specifically covered in writing, warranty benefits do not include failures, losses or damage caused by:
- Fire, water, flooding, freezing, storms or other natural events.
- Faulty or interrupted electrical, fuel or water supply.
- Theft, vandalism, misuse, abuse or improper operation.
- Lack of required maintenance.
- Alterations required because of changes in federal, state or local codes or regulations.
- Cosmetic conditions, paint, cabinets, knobs, buttons, rust or corrosion.
- Normal wear and tear that is not otherwise covered by an applicable repair warranty.
Repairs outside applicable warranty coverage require customer authorization and will be charged at the applicable rate.
If a customer declines a repair that Air Comfort reasonably determines is necessary for proper system operation and the unresolved condition contributes to additional failure or service calls, Air Comfort may limit related warranty coverage to the extent allowed by the agreement and applicable law.
Maintenance Requirement For Warranty Benefits
Required maintenance must be completed on equipment for which Comfort Plus repair warranty coverage is claimed.
Failure to complete required maintenance may affect applicable warranty coverage when the missed maintenance relates to the covered equipment or claimed failure.
Replacement Equipment Membership Benefit
While the membership is active and applicable payments are current, Air Comfort currently allows 50% of eligible Comfort Plus membership dues paid to be applied toward qualifying heating or cooling equipment purchased from and installed by Air Comfort, subject to current program requirements.
The member must remain at the service address associated with the membership unless Air Comfort approves otherwise.
Qualifying equipment may include:
- Furnaces
- Air conditioners
- Boilers
- Ductless mini-splits
- Heat pumps
- Air exchangers
- Dehumidifiers
This benefit has no cash value and applies only toward qualifying equipment purchased and installed by Air Comfort.
Events & Conditions Outside Program Coverage
Comfort Plus does not cover materials, parts, labor, damage or service made necessary by abuse, vandalism, fire, freezing, flooding, hazardous conditions, utility interruption or other causes outside the scope of the membership unless specifically covered in writing.
Air Comfort is not responsible for delays caused by circumstances beyond its reasonable control, including severe weather, natural disasters, parts availability, labor interruptions, unsafe site conditions or similar circumstances.
Promotional Offers
Air Comfort may offer limited-time or targeted promotional incentives from time to time.
Promotions may have separate eligibility requirements, expiration dates, equipment restrictions, service-area requirements or other conditions.
A promotion does not become a permanent Comfort Plus membership benefit merely because another Comfort Plus customer received it.
If a written promotional term conflicts with these standard Terms & Conditions, the promotional term controls only with respect to the specific promotion and only for an eligible customer who accepted that promotion.
Entire Agreement
These Terms & Conditions, together with the customer's enrollment information, selected equipment coverage, disclosed pricing, renewal disclosures and any applicable written promotional terms, constitute the Comfort Plus membership agreement.
No oral statement changes these Terms & Conditions unless Air Comfort confirms the change in writing.
